Section 3 Exceptions from requirement for marine zone

The requirement in section 2 does not apply to the operation of a ship by an employee of the Gladstone Area Water Board who is—

(a) a shipping inspector performing a function under section 153 of the Act; or

(b) carrying out a water activity under the Water Act 2000 relating to the board’s main function as a water authority under section 569 of that Act; or

(c) carrying out an activity under an authority issued to the board under the Fisheries Act 1994, section 49 for the following purposes—

(i) broodstock collection;

(ii) education;

(iii) fish stocking.
